A U.S. citizen has argued before Canada's Immigration and Refugee Board in Vancouver that he should be granted refugee status over fears that he will be killed in his home country by police because he is black.
Kyle Lydell Canty, 30, crossed into B.C.'s Lower Mainland in early September of 2015, telling border agents that he was here to visit and take photographs, but once in Vancouver decided he would apply to remain as a refugee.
"I'm in fear of my life because I'm black," he told IRB member Ron Yamauchi in a hearing on October 23rd in Vancouver. "This is a well-founded fear."
Canty argues that black people are "being exterminated at an alarming rate" in the U.S. and included examples such as the shooting of Michael Brown in Missouri and the death of Eric Garner in New York City at the hands of police.
Canty represented himself at the hearing, which he applied to have made public, and was commended by Yamauchi at its conclusion, who said Canty had put together a "well prepared case ... and argued it as well as it could be."

Canty submitted a significant evidence package to the IRB including videos, media reports and the UNHCR's handbook on determining refugee status.
In order for someone to be called a refugee in Canada, they must prove they are in danger in their home country, "that you're someone with a well-founded fear of persecution in your country, based on race, religion, nationality, political opinion or membership in a particular social group." said Melissa Anderson. who speaks for the IRB.
Born in New York, Canty has lived in six different states before arriving in Canada, a country he says he's never been to before.

Claims police harassment

He told the IRB that in every state he resided, police have harassed him and targeted him because of his race.
As part of evidence submitted to the board, Canty edited together multiple point-of-view videos of his interaction with police, including one where he was arrested for trespass in Salem, Oregon, when he spent two hours talking on the phone and using free Wi-Fi at a bus station.
"I got bothered because I'm black," he said. "This is a history of false arrest. My name is ruined because of the false arrest."

He described another video submitted to the IRB that shows a police car driving past him and then stopping.
Two officers emerge. Canty asks them why they are stopping. The officers reply they believed he was flagging them. When Canty says no, they depart without incident.
Yamauchi questioned Canty over whether or not this could be considered a negative, threatening interaction with police.
Canty admits that he has several outstanding charges in multiple states for things including jaywalking, issuing threats, disorderly conduct and resisting arrest but says he has no intention of returning to his home country to face those charges.
"I'm in fear of my life," he said. "I already know the outcome."
His goal is to stay in Canada where he says he feels safe and even comfortable enough to talk to police.
Canty wants to own a photography business and open a training centre for a martial art that he practises. Currently he is residing at a homeless shelter in Vancouver.

U.S. refugee seekers rare

No more than 10 U.S. citizens are granted asylum by the IRB in Canada each year. In 2013 there were only three.
Last year, the case of Denise Harvey made it all the way to Federal Court after an appeal by the government. She was convicted in the U.S. of having sex with a 16-year-old boy, but broke no Canadian laws and was granted asylum because the IRB agreed her punishment in the U.S. was cruel and unusual. The government appeal was unsuccessful.
IRB member Yamauchi has reserved his judgment on Canty's case.
If it is approved he can apply for permanent residency. If denied, removal from Canada is a possibility, but Canty says if he does not get a favourable result he will appeal.

September blew away the margin for Earth's warmest month on record

September 2015 was the warmest such month for Planet Earth since such data began in 1880, and very likely long before that, according to data released Wednesday by the National Oceanic and Atmospheric Administration (NOAA). The first nine months of the year were also record warm, increasing the likelihood — which was already 97% by one measure — that this will be the warmest year the planet has seen since at least 1880.
The superlatives for September 2015 are remarkable, and are the result of a combination of one of the top three most powerful El Niño events on record in the tropical Pacific Ocean plus long-term, manmade global warming.
The September globally averaged sea surface temperature was 1.46°F (0.81°C) above the 20th century average. This was the highest temperature for September in the 1880-2015 record, surpassing the previous September record set last year by 0.13°F (0.07°C). To date, seven months this year have been record warm, including the past five in a row, NOAA said.

Not only was September the warmest such month on record in NOAA's data set (as well as thatkept by the Japan Meteorological Agency), but it was also the greatest rise above average for any month in the 136-year historical record.
In other words, September had a global average surface temperature that was so far above normal that it set a record for the margin above average. This is sort of like a baseball player hitting a home run that travels a greater distance than any other home run on record for that particular stadium.
It reflects just how skewed the climate system is toward setting warm records.
In this case, September 2015 beat out February and March of this year for the greatest rise above average record, beating them both by 0.01 degrees Celsius, or 0.02 degrees Fahrenheit, NOAA found.
Six of the ten highest temperature departures from average have occurred in 2015, Jessica Blunden, a scientist at NOAA's National Centers for Environmental Information (NCEI) in Asheville, told Mashable in an email.
Or to put it another way, "Out of 1,629 monthly records since 1880, six months of 2015 are among the 10 highest monthly temperature departures from their respective averages," NOAA reported in its monthly climate summary.
Both land and ocean temperatures were record warm in September, as they have been for many other months this year so far. Ocean temperatures, in particular, were extremely mild, exceeding the previous record set in September 2014 by 0.13 degrees Fahrenheit, or 0.07 degrees Celsius.

This may seem like quibbling over very small differences, but consider that the discrepancy between the planet we know today and a planet with virtually zero ice cover in Greenland and Antarctica is about 10 degrees Fahrenheit, for a global average.
In short, big changes can occur as a result of relatively small differences in global average temperatures.
Typically, global average temperature records — whether they're months or years — are exceeded by far smaller margins. For example, the difference between the third warmest September and the fourth warmest September in the data set was just 0.1 degree Celsius, or 0.18 degrees Fahrenheit.
The year-to-date temperature across global land and ocean surfaces was 1.53 degrees Fahrenheit, or 0.85 degrees Celsius, above the 20th century average. This was the highest for January-September in the 1880-2015 record, NOAA said in a report posted online, surpassing the previous record set last year by 0.19 degrees Fahrenheit, or 0.12 degrees Celsius.
Again, this means that 2015 is tracking significantly above last year's temperatures, not just a small distance above that record. Both land temperatures and ocean temperatures are separately setting records for the mildest year on record so far, NOAA found.

The warm oceans have fueled a record number of Category 4 and 5 hurricanes and typhoons in the Northern Hemisphere so far this year, with 21 such storms, beating the old record of 18 set in 2004.

This is not only El Niño's doing

El Niño, which is characterized by milder-than-average ocean temperatures across the tropical Pacific Ocean, can pump more heat into the atmosphere and temporarily elevate global ocean temperatures. Such events, which typically occur every five to seven years, can temporarily boost global average temperatures, but they occur on top of longer-term trends.

As the planet warms in response to human activities, scientists say even weak El Niño events can put the planet over the edge into setting a temperature record. Since the ongoing event is unusually strong, the spike is even higher. However, it would be wrong to conclude that the entirety of the temperature spike is caused by El Niño, scientists say.
For example, so far this year, global average surface temperatures are running about 0.31 degrees Fahrenheit higher than at this point in 1998, which was a record-setting El Niño year. "This indicates that there are other factors beyond El Niño that are contributing to the warmth," Blunden said. "The fact that we continue to break records clearly shows our underlying global warming trend."

"The El Niño years keep getting warmer compared to one another, and the La Niña years keep getting warmer compared to one another. That's a clear signal that global warming underlies the variability of ENSOs and such we see over months and years," Blunden wrote, using the acronym for the larger climate cycle El Niño and La Niña events are a part of, known as the El Niño-Southern Oscillation.
Blunden also made clear that it's not just the El Niño regions of the Pacific Ocean that are record warm, either. "The northeast "Pacific Blob" has been present for the better part of two years and the entire Indian Ocean has been incredibly warm," she wrote. "And now we're starting to see more record warmth emerge in parts of the Atlantic. It truly is the global oceans driving our record heat."
The oceans absorb the vast majority of the additional heat being pumped into the climate system by skyrocketing concentrations of global warming pollutants in the atmosphere, including carbon dioxide.

In the photo, Heath Morrow can be seen in blackface while wearing Kanye's signature glasses and holding the sign "Kanye for Prez 2020."
The couple posted the photo on Facebook, but took it down following an uproar.
"I didn't know dressing up as a celebrity couple would cause so much controversy," Shannon Morrow wrote in a message to the Daily News on Monday. "There was no malicious intent in this costume. It's for HALLOWEEN, the one time a year it is okay
"Some of my husband's best friends are black," she continued. "There was no racial intent whatsoever."

"I wasn't raised or taught that way and do not raise my children that way," he continued. "I see people for who they are, and my wife and I go out of our way to help anyone we can in my profession as any educator. When deciding to dress up for a Halloween party, my wife and I made a decision based on celebrities and the political climate today. I do not want this to reflect on my school or school system based on a poor decision that I made. Again I apologize and this will not happen again."

U.S. Federal Prisons Will No Longer Serve Pork

The United States Bureau of Prisons has announced a ban on pork. Prison inmates will no longer be able to dine on swine in 122 federal penitentiaries. The pork ban was enacted after officials noticed nationwide that it wasn’t popular among inmates.
Bureau spokesperson Edmond Ross says, “Why keep pushing food that people don’t want to eat? Pork has been the lowest-rated food by inmates for several years, and we were paying more than what we’d like to pay.”
Ross said that inmates are becoming more health conscious these days, which he believes may be a contributing factor in the decline of pork consumption. However, there are some naysayers. One being National Pork Producers Council spokesperson Dave Warner, who thinks the bureau is full of it. Warner went on to say, “I find it hard to believe that a survey would have found a majority of any population saying, ‘No thanks, I don’t want any bacon.’”
He added that there are benefits to pork that beats beef and chicken, such as pork being inexpensive and healthy. “We’re nutritious,” continued Warner. “A boneless pork chop or loin is a very healthy alternative to lots of other foods.”
Critics of the pork ban have argued on social media even to go so far as to blame this decision on the Obama administration and even President Barack Obama himself. Claiming that Obama is bending to the demands of Muslims.
These are accusations that Council on American-Islamic Relations spokesman Ibrahim Hooper expected. He stated, “It will stoke the fires of Islamophobia based on the usual conspiracy theories,”
However, Hooper did confess that he is pleased with the change in inmate meals because it will be easier on prisoners of the Islamic faith. “In general, we welcome the change because it’s facilitating the accommodation of Muslim inmates,” he said. “We hope it’s not an indication of an increasing number of Muslims in the prison system.”
Muslims and Jewish inmates who do not eat pork for religious reasons are allowed meal alternatives and are provided with halal and kosher dishes.

Corey Jones, the Florida musician who was fatally shot by a police officer Sunday morning, did not fire his weapon, his family’s lawyer, Benjamin Crump, said at a news conference Thursday morning, and added that the officer was not carrying his badge at the time of the shooting.
“He went to his grave not knowing if this was a real cop or not,” Crump said. “Nobody understands how this could happen to Corey Jones.”
Jones, 31, was on the side of the road in Palm Beach County when his car broke down at approximately 3:15 a.m. on Sunday. He was waiting for a tow truck when officer Nouman Raja, who was in plainclothes, arrived in an unmarked van.
Palm Beach Gardens police said Jones “confronted” Raja, who then fired at Jones. A gun Jones had legally bought three days earlier was found at the scene, police said. In a press conference earlier this week, police said Jones was holding the gun as Raja approached, though it is unclear if Jones pointed it toward the officer.
On Thursday morning, Crump said Raja discharged his weapon six times, striking Jones at least three times. Police have remained mum on the details of the shooting. Police have not confirmed wither Raja and Jones got into a verbal confrontation before the shooting.
Crump and Jones’ family members called on local police and the state attorney for answers about what happened, including why the officer didn’t have a badge, why Jones’ body was not found near his car, and why the gun was not hear Jones’ body.
Earlier this week, Palm Beach Gardens Police Chief Stephen Stepp said the police department has no video of the incident, as there was no dashboard camera installed in the officer’s car, nor does the department issue body cameras.
Raja, who is now on paid administrative leave, was with the Palm Beach Gardens police department for just six months. In his application for the job, he failed to disclose that he had been reprimanded at this previous police job, according to theNew York Times.
At this previous job with the police department in Atlantis, Florida, Raja failed to turn over morphine pills recovered from a suspect. Raja never wrote a report or submitted the evidence, according the Times, citing Atlantis police internal affairs file. Due to Raja’s actions, prosecutors were forced dropped the case against the suspect.
On his application for the Palm Beach Gardens police department, Raja only listed minor incidents, when asked if he had ever been reprimanded.
When hired, the police department paid him 5% more than other rookies because of his “exceptional experience,” according to the Times.
Members of the Florida Legislature’s Black Caucus called on governor Rick Scott to start an independent investigation into the incident.
At Thursday’s press conference, Jones’ sister Melissa, his brother CJ, and his father spoke about Jones and his love for music and drumming.
The family said Jones purchased a gun for his protection, because he often rode in his car with very expensive musical instruments and band equipment.
“Corey always loved the drums,” his sister Melissa, said. “Growing up he would make drums out of books, pans, anything and play for hours. He had a gift like no other.”
Jones father, Clinton Jones St., called for people to “keep the beat alive for Corey.”

Ohio School Bans Afro Puffs And Braids (UPDATE)

The Lorain Horizon Science Academy in Ohio is facing heat from the natural hair community after a copy of a letter to parents that included a ban on afro puffs and 'small twisted braids' was posted online.
The letter details changes to the dress code for the upcoming school year and includes the line:
Afro-puffs and small twisted braids, with our without rubberbands, are NOT permitted.
It's unclear what the administration means by small twisted braids, but if they are referring to box braids they are banning a protective style that black girls have worn for generations. Afro-puffs are essentially the black version of the ponytail (when pulled back our hair puffs out instead of laying down), and yet the rules do not have a ban on ponytails for students of other ethnicities.

NYPD Officer Randolph Holder dies after being shot in the head by gunman in East Harlem



An NYPD housing officer was killed Tuesday night, shot in the head by a trigger-happy perp during a chase and gunfight on a pedestrian overpass above FDR Drive in East Harlem, police said.
Officer Randolph Holder, 33, was shot in the forehead by the callous gunman, who had stolen a bike and was being pursued by cops along the promenade hugging the East River around 8:30 p.m., Police Commissioner Bill Brattonsaid. The brave officer died at 10:22 p.m. at Harlem Hospital.
A suspect, shot in the legs, was arrested.

Holder, who emigrated from Guyana, was a third-generation police officer, following in his father and grandfather’s footsteps in the line of duty, Bratton said during a somber press conference at the hospital.
The unmarried immigrant joined the NYPD in July 2010 and worked in Police Service Area 5, wearing Shield No. 13340 as he patrolled the public housing projects of East Harlem.






“I think all of us will tell you this is the hardest thing that we do,” Bratton said. “That we mourn one of our own. I’ve been doing this for 45 years. It doesn’t get easier. It never gets easier and it should never get easier.”
Holder was the fourth NYPD officer killed in the line of duty in the past 11 months.

I had my whole family on the floor,” said witness Doris Ayala, 62, who lives at the Urban American River Crossing apartment complex at 102nd St. and FDR Drive.
“I thought they were going to shoot outside of my window. There was a gun on the sidewalk outside my building,” said the shocked woman, who reported hearing about 10 shots.
One of the men stole a bicycle and fled north along the footpath.

Holder and another cop encountered the fleeing suspect on another pedestrian overpass, near 120th St., and exchanged gunfire.
“There were six or seven shots, they were exchanging fire,” said John Lucero, 19, who could see the shooting from his apartment window. “There were three of them, one police officer and two other men. Cops were pointing at a body. It was a police officer. He was just lying there.”
The mortally wounded Holder crumpled to the ground as the ruthless suspect ditched the bike and ran north along the promenade. The fiend was finally apprehended at 124th St.
He suffered gunshot wounds to his legs and was taken to New York-Presbyterian Hospital Weill Cornell.

Commissioner Bratton and Mayor de Blasio held a press conference at Harlem Hospital following Officer Randolph Holder's death. PBA spokeman Pat Lynch (r.) also spoke.

Mayor de Blasio was seen rushing out of a dinner for the Gracie Mansion Conservancy, an invitation-only fund-raiser to celebrate the grand reopening of the mayoral residence after recent repairs.
“We’re all in mourning tonight. This whole city is in mourning,” Mayor de Blasio said. “We’re mourning a man that gave his life as a guardian for all of us.

“We are humbled by Officer Randolph Holder’s example of service and courage and sacrifice. Our hearts are heavy. We offer our thoughts and our prayers to his family who are experiencing unimaginable pain as we saw earlier when we gathered with them,” the mayor said.
Traffic on the FDR Drive was at a standstill for hours as police investigated the shooting.
Dozens of people were seen exiting taxis and walking toward First and Second Aves. in search of other means of transportation.
Witnesses watched as emergency crews cut the guardrail separating the northbound and southbound lanes near 116th St. to allow cars to turn around and exit the clogged roadway around 11:30 p.m.
At Harlem Hospital, hundreds of police officers held vigil, hoping for the best before they received the grim news of their fallen colleague.
“New York City police officers everyday go out and carry themselves on the street like superheroes on the street," Patrolmen’s Benevolent Association President Patrick Lynch said. “But the reality is, when we’re attacked, we bleed. When we bleed, we die. And when we die, we cry.”
The slain office’s father was on hand at the hospital. In his moment of grief, he offered his son’s fellow officers comfort.
“When in his time of grief, he sought to comfort the officers of PSA 5. He was strong enough and brave enough to go in and address them as they tried to comfort him. He in fact was comforting them,” a teary-eyed Bratton said.
“I can understand his son and the bravery his son exhibited tonight, rushing toward danger and giving his life for the citizens of New York City.”
At least 100 NYPD officers were seen leaving the hospital around 11:30 p.m.
Three other NYPD officers have been shot and killed while on the job in the last 12 months.
On Dec. 20, officers Wenjian Liu, 32, and Rafael Ramos, 40, were ambushed and assassinated by a gun-toting madman in Bedford-Stuyvesant, Brooklyn.
Officer Brian Moore, 25, was working with an anti-crime unit and patrolling in an unmarked police car with his partner Erik Jansen on May 9 near 212th St. and 104th Ave. in Queens when he was gunned down and killed.
